New Rules for Rent Arrears Termination Notices (N4): Timelines Cut in Half

For Ontario landlords dealing with unpaid rent, time is literally money. The longer a tenant remains in arrears, the greater the financial strain on the property owner. In a major shift aimed at addressing delays such as these, the Ontario government has introduced a critical change to the eviction process for non-payment of rent.

 

Starting September 21, 2026, the mandatory waiting period on an N4 notice is being slashed in half. Here is exactly what this means for housing providers and tenants across the province.

 

The 14-Day Window is Now 7 Days

Historically, when a tenant on a monthly or yearly lease failed to pay rent, a landlord would serve an N4 Notice to End the Tenancy for Non-payment of Rent. The law required the landlord to give the tenant a 14-day "cure period" to pay the missing rent before any further legal action could be taken.

 

As of September 21, 2026, that 14-day window drops to just 7 days.

 

What This Means for Landlords

This legislative change accelerates the timeline for landlords to seek recourse through the Landlord and Tenant Board (LTB):

 

●     Faster L1 Filing: If the tenant does not pay the full arrears within the new 7-day window, the landlord can immediately file an L1 Application to Evict a Tenant for Non-payment of Rent.

●     Securing Your Place in Line: Because LTB wait times can still sometimes take several months, shaving a full week off the initial notice period allows landlords to get into the hearing queue faster.

●     Zero Tolerance for Early Action: It is crucial to remember that this new timeline is strictly enforced starting September 21. If you serve an N4 with a 7-day termination date before this law officially takes effect, the notice will be legally void, and you will be forced to start the entire process over from day one.

 

What This Means for Tenants


For tenants, the margin for error has technically vanished.

 

●     A Tighter Payment Window: If you receive an N4 notice on or after September 21, 2026, you will only have 7 days to pay the owed rent.

●     Voiding the Notice: The fundamental rule remains the same: if a tenant pays the full amount of arrears before the 7-day termination date, the N4 notice immediately becomes void, and the landlord cannot proceed with an eviction application.


The Bottom Line

This update fundamentally alters the rhythm of rent collection in Ontario. Landlords must update their operational procedures to ensure they are ready to issue 7-day notices the moment the law takes effect, while tenants must understand that the grace period for late rent has been drastically reduced.
